Lecture — Reflections on Malaysian Intellectual Property Law

Synopsis

The lecture will feature Associate Professor Tay Pek San from the University of Malaya. Dr Tay will discuss the journey of IP protection in Malaysia, focusing on the major contributions that have played an instrumental role in defining the scope of this area of law. In particular, Dr. Tay will address how Malaysian IP law has progressed through the years as a result of various internal and external forces. These forces include the ASEAN IP cooperation initiatives, which are targeted, inter alia, to harmonize the regional protection of IP in ASEAN countries. Other significant factors in shaping Malaysian IP law have been the influence of the British legal tradition, the country’s ambition to be internationally competitive, the commitments under multilateral and bilateral treaties, the obligations pursuant to free trade agreements, the challenges posed by technological advances and national interests. In 2017, Malaysia was ranked second in ASEAN in terms of intellectual property protection in the recently released U.S. Chamber International IP Index, and the country’s IP journey will certainly continue, even more ambitiously, in future years. 

 

Speaker

Dr Tay Pek San is Associate Professor at the Faculty of Law, University of Malaya, Kuala Lumpur. She is also the legal advisor to the University of Malaya Centre of Innovation & Commercialization, a committee member of the Intellectual Property Chapter of the International Chamber of Commerce (Malaysia) and a committee member for the Evaluation of Intellectual Property of the University of Malaya. She has published many articles and book chapters in intellectual property law. She is a co-author of the book “Introduction to Cyberlaw in Malaysia” (Advanced Professional Courses, 2004), author of “Protection of Well-Known Trade Marks in Malaysia” (Sweet & Maxwell Asia, 2007) and “Intellectual Property Law in Malaysia” (Sweet & Maxwell Asia, 2013). Her latest work is as co-author of the fourth edition of “Khaw on Copyright Law in Malaysia", which is expected to be published in early July 2017.

 

Commentator

Irene Calboli is Lee Kong Chian Fellow, Visiting Professor, and Deputy Director of the Applied Research Centre for Intellectual Assets and the Law in Asia, School of Law, Singapore Management University. She is also Professor of Law at Texas A&M University School of Law, and Fellow at the Transatlantic Technology Law Forum at Stanford Law School. Her recent scholarship focuses on IP laws in ASEAN with a specific interest on trademarks, geographical indications, and cultural assets. She is an elected member of the American Law Institute and an associate member of the Singapore Academy of Law. She serves in several leadership roles, including as member of the Council of the International Law Association (Singapore Branch), Chair-Elect of the Art Law Section of the Association of American Law Schools, and member of the Legislation and Regulation Committee of the International Trademark Association.

 

Moderator

Kung-Chung LIU holds LLB and LLM degree from National Taiwan University and a Doctor of Law degree from the Ludwig Maximilian Universitaet (University of Munich). He was a Research Fellow at Academia Sinica, Taiwan between 1992/1-2017/1. In 2003,  he was a Visiting Professor at the Faculty of Law of the National University of Singapore and  Visiting Senior Research Fellow for the IP Academy of Singapore. Professor Liu has served as one of the founding Commissioners of the National Communications Commission in Taiwan between 2006 and 2007. In 2014/4-15/7, he was a Visiting Professor at the School of Law, Singapore Management University, and the Founding Director of the Applied Research Centre for Intellectual Assets and the Law in Asia (ARCIALA). He is currently the Director of ARCIALA. In addition, Professor Liu has been co-appointed Professor of the Renmin University, China (2017), and of the Graduate Institute of Technology, Innovation & Intellectual Property Management, National Chengchi University, Taiwan (since 2010).
